Clearance Deals Online Auctions – Burlington, Ontario
1. General Overview
These Terms and Conditions (“Terms”) govern all participation in online auctions conducted by Clearance Deals Online Auctions (“Clearance Deals”). By registering, bidding, or purchasing from any auction hosted by Clearance Deals, you (“the Bidder” or “the Buyer”) acknowledge that you have read, understood, and agree to be legally bound by these Terms.
2. Eligibility and Registration
All participants must be 18 years of age or older.
Registration requires complete and accurate personal information. Clearance Deals reserves the right, at its sole discretion, to approve, suspend, restrict, or revoke any bidder registration.
Each bidder account is personal and non-transferable. The registered bidder is responsible for all activity conducted through their account.
3. Bidding Rules
All bids are final, binding, and non-retractable.
Clearance Deals reserves the right to refuse or cancel bids, withdraw or re-list items, correct errors, or reopen an auction or individual lot where reasonably necessary.
The highest bid accepted at the close of an auction constitutes a binding agreement to purchase the item, subject to these Terms.
4. Buyer’s Premium, Handling Fees & Taxes
A 14% Buyer’s Premium will be added to the final winning bid price.
A $1.50 handling fee per item will also apply.
All purchases are subject to applicable HST/GST and any other taxes required by law.
The Buyer’s Premium, handling fees, applicable taxes, and winning bid amount form part of the total amount payable by the Buyer.
5. Payment Terms
Full payment must be received within 24 hours after the auction closes.
Accepted payment methods may include:
• E-Transfer
• Debit
• Credit Card
• Cash, if pre-approved by Clearance Deals
All sales are final. Except where required by applicable law, no refunds, cancellations, exchanges, or chargebacks will be accepted.
6. Pickup and Removal of Items
All purchased items must be picked up within the designated pickup period, generally 2–4 days following the auction closing date, at the Clearance Deals pickup location in Burlington, Ontario.
Buyers are responsible for reviewing and following the pickup schedule and instructions provided for each auction.
Items that are not collected within the designated pickup period may be considered abandoned or forfeited without refund, subject to applicable law.
7. Item Condition and Inspection
All merchandise is sold “AS IS,” “WHERE IS,” and “WITH ALL FAULTS.”
Unless expressly stated otherwise, Clearance Deals makes no warranties or guarantees regarding an item's condition, functionality, completeness, merchantability, fitness for a particular purpose, or other characteristics.
Descriptions, photographs, model numbers, measurements, and other information are provided for identification and reference purposes only.
Buyers are responsible for reviewing all available photographs and descriptions and, where available, inspecting merchandise during designated preview periods before bidding.
8. Default and Remedies
Failure to comply with payment, pickup, or other auction requirements may result in cancellation of the transaction, forfeiture of purchased items, suspension or termination of bidding privileges, and restriction from participating in future Clearance Deals auctions.
Where permitted by law, Clearance Deals reserves the right to pursue recovery of losses, costs, or damages resulting from a bidder's default.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Clearance Deals shall not be responsible for direct, indirect, incidental, special, or consequential damages arising from participation in an auction, use or misuse of purchased merchandise, or reliance upon auction descriptions or photographs.
Nothing in these Terms excludes or limits any liability or consumer right that cannot legally be excluded or limited under applicable law.
10. Privacy and Data Protection
Personal information collected through auction registration, bidding, purchasing, payment, and pickup processes will be used for legitimate auction administration and business purposes in accordance with applicable privacy laws.
By participating in Clearance Deals auctions, bidders acknowledge the collection and use of their information for these purposes.
11. Modifications to Terms
Clearance Deals reserves the right to amend or update these Terms from time to time.
The Terms applicable to an auction will be those presented or made available in connection with that auction. Continued participation after updated Terms are made available constitutes acceptance of those Terms.
